TN Visa (USMCA) for Canadian and Mexican Professionals

TN is a work status under the USMCA trade agreement (formerly NAFTA) for Canadian and Mexican citizens with a US job offer in a profession on the official list. It is granted for up to 3 years and can be extended. We check whether your profession qualifies and prepare your package for the border or the consulate. Our fee is $500.

For Canadian and Mexican citizens only
Work in the US for up to 3 years, renewable
No lottery and no annual cap

Have a US job offer and a Canadian or Mexican passport? Message us and we'll check your profession.

We reply in your messenger within one business day.

What the TN visa is and what we do

TN is a category for Canadian and Mexican professionals under USMCA. The list has more than 60 professions: engineers, accountants, computer systems analysts, scientists, physicians for teaching and research, registered nurses and others. You need a job with a US company or organization, and self-employment is not allowed.
The key to a TN case is that three things match: a profession on the list, your degree or license, and the job described in the employer's letter. If they don't match, CBP or the consulate will refuse.

We are immigration lawyers, not a US law firm: we prepare your documents and do not represent clients before US authorities. You present your documents at the border or the interview yourself, with our guidance.

Profession check

We compare your job title and duties with the USMCA list and its education requirements. Whether your case fits, we confirm at the consultation.

Employer support letter

We help prepare the letter: the profession on the list, duties, length of employment, qualifications and pay. It is the key document of the case.

Document package

Degrees, licenses, experience letters and a foreign credential evaluation if needed. For Mexican citizens, the DS-160 form and interview preparation.

Extensions and new employers

We explain how to extend TN or move to a new employer, through a USCIS petition or at a new entry.

Who gets TN and how

The process differs for Canadian and Mexican citizens. Permanent residents of these countries who are not citizens cannot get TN.

Three cases

Canadian citizens
No visa is needed. You apply for TN status at a port of entry or at a preclearance location in a Canadian airport, with the employer's letter and education documents. The CBP fee is paid on the spot.
Mexican citizens
You need a TN visa from a US embassy or consulate in Mexico: the DS-160 form, a $185 fee and an in-person interview. Then you enter the US with the visa.
Family - TD status
Your spouse and unmarried children under 21 get TD status for the same period. They cannot work in the US, but they can study.

How to get TN status

Timing depends on the route. Canadians get a decision at the border on the day of entry, Mexicans after the consular interview. Your I-94 record, not the visa, sets how long you can stay.

01
Consultation
We check your profession, education and job offer. A consultation costs $150.
02
Employer letter
We work with your employer on a letter that matches the USMCA list and your qualifications.
03
Documents
We gather degrees, licenses, experience letters and translations. For Mexican citizens, the DS-160 and the interview appointment.
04
Border or consulate
A Canadian presents the documents at the border, a Mexican attends the interview. We prepare you for the questions.
05
Extension
TN can be extended up to 3 years at a time with no overall limit, through an employer petition to USCIS or at a new entry.

TN is not meant for permanent immigration: at every entry and extension you must show that the job is temporary. If you plan a green card, we discuss it separately.

Common reasons for TN refusals

TN refusals are almost always about the documents, not the worker. This is what we check in advance.

The profession is not on the USMCA list
The job in the letter doesn't match the degree
Only experience instead of the required degree
Working for your own company
Signs of intent to stay in the US permanently

If your profession is not on the list, look at other options: the O-1 visa, the E-2 visa for investors or EB-2 NIW.

Frequently asked questions

Who can get a TN visa?
Only Canadian and Mexican citizens with a US job offer in a profession on the USMCA list and a matching degree or license. Permanent residents of these countries who are not citizens cannot get TN.
Which professions are on the TN list?
More than 60, including accountant, engineer, architect, computer systems analyst, management consultant, scientists, medical professions and university teachers. Most require a bachelor's degree, some a license or a diploma plus experience.
How does a Canadian get TN status?
No visa is needed. You present your documents at a port of entry or a preclearance location in a Canadian airport and pay the CBP fee there. Your employer can also file Form I-129 with USCIS in advance.
How does a Mexican citizen get a TN visa?
At a US embassy or consulate in Mexico: the DS-160 form, a $185 fee and an in-person interview. With the visa, you enter the US and are admitted in TN status.
How long is TN valid and can it be extended?
Up to 3 years. It can be extended up to 3 years at a time with no overall limit, as long as the job remains temporary. Extensions go through an employer petition in the US or a new entry.
Can I change employers on TN?
Yes, but you can start working for the new employer only after approval: the new employer files Form I-129, or you re-enter with the new employer's letter.
Can I get a green card while on TN?
TN does not allow dual intent, so applying for a green card needs careful planning. We discuss it at the consultation before you start.
TN or H-1B - which is better?
TN has no lottery and no annual cap, and it is faster and cheaper. But it is only for Canadian and Mexican citizens and only for professions on the list.
