Changing Status in the US without Leaving the Country

How long does the change of status process take?
The time frame depends on your current and desired status. The workload of USCIS also plays a role. On average, the process can take from 6 to 18 months.
Do I need to leave the US to change my status?
Usually, you don’t need to leave the country if you are in the country legally. In some cases, there may be visa restrictions. In that case, you will have to leave the country and get a visa through the consulate. That’s why it’s best to consult with an immigration expert at the start.
Can I work while adjusting my status?
You can only work if you receive an Employment Authorization Document (Form I-765).
What should I do if my current status is about to expire?
It is important to apply for adjustment of status before your status expires. Once submitted, you have the right to remain in the United States until USCIS makes a decision, even if your visa expires.
What documents are needed to change status?
The standard list includes:
  • completed forms (e.g. I-485, I-539, I-765);
  • proof of current status (visa copies, I-94);
  • reasons for changing status. For example, Form I-20 for F-1, proof of marriage for a green card;
  • financial documents;
  • medical certificates (for a green card).
