Advance Parole Travel Document (Form I-131)

If you filed for a green card inside the US and need to travel, leaving without advance parole usually means abandoning your application. We prepare Form I-131, file it with USCIS and follow the case until you get the document. Our fee is $350. The USCIS fee is paid separately.

What we do for your advance parole

Advance parole is a USCIS document that lets you travel abroad and return without abandoning a case pending inside the US. Most often, people who filed Form I-485 for a green card need it. You apply for it with Form I-131.
You must have the document before you leave. If you travel earlier, USCIS usually treats your green card application as abandoned. So we file early and check whether the trip creates any risk for your status.

We are immigration lawyers, not a US law firm: only attorneys licensed by a US state can represent clients before USCIS. You sign the application, and we file it for you.

Check before filing

We review your basis (pending I-485, TPS, parole), your history in the US and any past violations. We tell you whether the trip is safe and which fee applies.

Preparing Form I-131

We complete the application, choose the right document type, describe the purpose and dates of your trip, and prepare photos and copies.

Filing with USCIS

We file online through your USCIS account if your category allows it, or by mail. It can be filed together with Forms I-485 and I-765.

Support until you get the document

We track the case, explain USCIS notices, prepare a response to a request for evidence (a separate service for $250) and tell you what to take on the trip.

Who needs advance parole

Below are common cases. Whether yours fits, we confirm at the consultation.

Common cases

Pending I-485 green card application
The most common case. While your I-485 is pending, leaving without advance parole usually means abandoning it. The exception is people who maintain H-1B or L-1 status (and their families), who can return on their visa.
TPS
To travel with TPS, you file the same Form I-131 for a separate document, the TPS travel authorization. The fee is the same as for advance parole.
Parole and other bases
You can also request advance parole with parole, a pending asylum case and in some other situations. Here it is important to assess the risks in advance: a separate $1,050 fee may apply when you return.

How to get advance parole

USCIS processing times change every month. Check the current ones on the USCIS processing times page. In urgent cases, such as a relative's serious illness, you can ask the USCIS Contact Center for an appointment at your local field office.

01
Consultation
We review your basis, history in the US and travel plans, and discuss the risks. A consultation costs $150.
02
Preparation and documents
We complete Form I-131 and gather copies of your status, USCIS receipts and photos. You review and sign the application.
03
Filing and receipt notice
We file online or by mail and pay the fee. USCIS sends a Form I-797 receipt notice with your case number.
04
Biometrics
If USCIS schedules fingerprints and a photo, you get a notice with the date and address. We explain what to bring.
05
Document and travel
Once approved, the document is mailed to you. You can leave only after you have it in hand.

Advance parole does not guarantee entry: CBP makes the decision at the border. That is why we check your documents and history before the trip.

Risks we check before the trip

With advance parole, mistakes usually happen in planning the trip, not in the form. This is what we discuss in advance.

Leaving before the document arrives - your green card application is treated as abandoned
A period of unlawful presence in the US - the risk needs to be assessed
The document does not guarantee entry - CBP decides
A $1,050 fee on entry with parole if you are not a green card applicant
A trip longer than the document's validity

If you are applying for a green card inside the US, Form I-131 can be filed together with I-485 as part of our adjustment of status package.

Frequently asked questions

What is advance parole?
It is a USCIS document that lets you travel abroad and return without abandoning a case pending inside the US, most often an I-485 green card application. You get it with Form I-131 before you leave.
What happens if I leave without advance parole?
If you have a pending I-485, USCIS usually treats it as abandoned, and you have to start over. The exception is people who maintain H-1B or L-1 status and return in it, and their families.
How much does advance parole cost?
Our fee is $350. The USCIS fee with a pending I-485 is $630 on paper or $580 online, or $0 if your I-485 was filed with a fee before April 1, 2024. On other bases, a $1,050 fee may also apply on entry.
Do green card applicants pay the $1,050 fee?
No. The law exempts a lawful adjustment of status applicant returning after temporary travel abroad. The fee applies to people entering with parole on other bases.
How long does I-131 processing take?
It depends on the USCIS workload and changes every month. Check the USCIS processing times page. In urgent cases, you can ask for an appointment at your local USCIS office.
Does advance parole guarantee entry to the US?
No. It lets you return and request entry, but CBP decides at the border. That is why we check your history and documents before the trip.
Can I file Form I-131 online?
Yes, if your basis is a pending I-485 or TPS, and the online fee is lower, $580. On some other bases, such as parole, the form is filed on paper only.
Can I file Form I-131 together with my I-485?
Yes. Many applicants file Forms I-485, I-765 and I-131 as one package, so the work permit and advance parole are processed while the green card case is pending. In our adjustment of status package, these forms are already included.
