Extend Your Stay in the US - Form I-539 for B-2 Visitors and Students

How long you can stay in the US is shown on your I-94 record, not on your visa. If you need more time, you file Form I-539 with USCIS before that date. We prepare the application and documents for B-2 visitors and F and M students, and for a change of status from B to F-1. Extension - $500, change to F-1 - $1,250.

B-2 visitor extension for up to 6 months
F or M student status extension
Change from B-2 to F-1 without leaving the US

Is your I-94 date coming up? Message us and we'll tell you whether you can extend.

We reply in your messenger within one business day.

What we do for your Form I-539

Form I-539 is the USCIS application to extend your stay or change your nonimmigrant status inside the US. What gets extended is your stay on the I-94 record, not the visa in your passport. A new visa can only be issued by a consulate abroad.
USCIS extends your stay if you have a good reason to remain and you follow the terms of your status: you don't work, don't study on a B visa, can support yourself and plan to leave.

We are immigration lawyers, not a US law firm: only attorneys licensed by a US state can represent clients before USCIS. You sign the application, and we file it for you.

Dates and eligibility check

We review your I-94, visa and reason for extending, and tell you whether you have a chance and how much time is left to file.

Statement and evidence

We prepare an explanation of why you need to stay, proof of funds, a return ticket or departure plan, and documents showing your ties to home.

Preparing and filing I-539

We complete the current edition of the form and file online or by mail to the correct address. Family members are included in the same application.

Support until the decision

We track the case, explain USCIS notices and prepare a response to a request for evidence. A response to a request is a separate service for $250.

When to file Form I-539

Below are three common cases, including a change of status from B to F-1. Whether yours fits, we confirm at the consultation.

Common cases

B-2 visitor extension
Parents visiting their children, tourists, medical treatment. You can extend for up to 6 months at a time if you have a reason and the funds. File before your I-94 date. USCIS suggests at least 45 days in advance.
F or M student status extension
For students who need more time to finish a program, the school usually handles the extension in SEVIS. Form I-539 is needed in specific cases, such as reinstatement or M students.
Change of status from B to F-1
You can switch to study without leaving the US. You need a Form I-20 from the school, a paid SEVIS fee and Form I-539. You cannot start classes before approval.

How to extend your stay in the US

USCIS processing times change every month. Check the current ones on the USCIS processing times page. You can check your own stay date on your I-94 record on the CBP website.

01
Consultation
We check your I-94, reason for extending and risks. A consultation costs $150.
02
Documents
We gather the explanation, proof of funds, insurance, tickets and copies of documents.
03
Filing Form I-539
We file online or by mail before your I-94 date and pay the USCIS fee.
04
Biometrics
If USCIS schedules fingerprints and a photo, you get a notice with the date and address. We explain what to bring.
05
Decision
If approved, you get a new I-94 with a new date. If denied, you leave the US.

If you filed on time, you usually wait for the decision in the US. If USCIS denies it, you need to leave right away so that you don't overstay.

Common extension mistakes

Denials and status violations usually come from these situations.

Filing after the I-94 date has passed
Confusing an extension of stay with a new visa
Starting classes before the B to F-1 change is approved
Working in the US on a B visa
No proof of funds or departure plan

If you need a new visa rather than more time, it is issued by a consulate abroad - see our B1/B2 visa page. Consular fees are explained in our article.

Frequently asked questions

Can I extend my B-2 stay without leaving the US?
Yes, with Form I-539, if you have a good reason to stay, enough funds and you follow the terms of your status. Extensions are granted for up to 6 months at a time.
When should I file for an extension?
Before the date on your I-94. USCIS suggests filing at least 45 days in advance. Late filing is accepted only in extraordinary circumstances.
How much does an extension cost?
Our fee is $500. The USCIS fee is $470 on paper or $420 online. A change from B to F-1 is $1,250 for our work, plus the USCIS fee and the $350 SEVIS fee.
Can I stay in the US while my I-539 is pending?
If you filed on time, you usually wait for the decision in the US. If it is denied, leave right away. You cannot work or study on a B visa during this time.
Is extending my stay the same as extending my visa?
No. An extension of stay is a new date on your I-94, granted by USCIS inside the US. The visa in your passport is not extended in the US: a new visa is issued by a consulate abroad.
How do I change from a tourist visa to F-1?
You need a Form I-20 from an SEVP-certified school, a paid $350 SEVIS fee and Form I-539 filed while your B status is valid. You can start classes only after approval. More on student status at Study in the States.
What happens if USCIS denies my extension?
Leave the US as soon as possible. Staying longer builds up unlawful presence, which will hurt your future visa applications.
Can I include my family in the application?
Yes, a spouse and children are usually included in one Form I-539 with the supplement Form I-539A. We confirm the package at the consultation.
