Spousal Sponsorship in Canada - Spouse, Common-Law or Conjugal Partner

A Canadian citizen or permanent resident can sponsor a husband, wife or partner for permanent residence. We check whether you both qualify, choose the inland or outland route, prepare the sponsorship and PR applications and the relationship evidence. The applications are submitted together in the Permanent Residence Portal. Our fee is CAD 2,000 per sponsorship application, IRCC fees are paid separately.

Planning to sponsor your spouse or partner? Write to us - we will check where to start.

We reply in messengers within one business day.

What we do for your spousal sponsorship

Spousal sponsorship is two applications filed together. The Canadian sponsor applies to become a sponsor and signs an undertaking to support the partner for 3 years after they become a permanent resident. The partner applies for permanent residence. IRCC checks both of you, including whether the relationship is genuine.
Most of the work is in the evidence. A marriage certificate alone proves little, so we build the file around how you met, how you live and what you plan together.

We are immigration lawyers with almost 20 years in immigration. We prepare the applications and evidence, you both review and sign them yourselves in the portal.

Sponsor and partner check

We check that the sponsor can sponsor (status, residence in Canada, past sponsorships, social assistance) and that the partner has no obvious inadmissibility issues.

Route and category

Spouse, common-law partner or conjugal partner - and inland or outland. The choice affects work during processing, travel and appeal rights.

Forms and evidence

We fill out the sponsorship and PR forms, declare every family member and organize the relationship evidence - photos, messages, joint lease or bills, travel records.

Follow-up with IRCC

We explain IRCC letters, medical exam and biometrics instructions, and prepare answers to requests for documents.

Who you can sponsor

The partner must be at least 18 and in a genuine relationship with you, not one entered into only to immigrate. IRCC recognizes three types of relationships.

Relationship types

Spouse
You are legally married. Any gender, both of you at least 18.
Common-law partner
You are not married but have lived together for at least 12 consecutive months. Short trips apart for work or family are fine, long separations are a problem.
Conjugal partner
You have been in an exclusive relationship for at least 1 year but could not live together or marry for legal, religious or similar reasons. The partner must live outside Canada.
Inland or outland
Inland - the partner lives in Canada with you and can apply for an open work permit while waiting. Outland - the partner can be anywhere, and if IRCC refuses, the sponsor can appeal to the Immigration Appeal Division.

How spousal sponsorship works

IRCC processing times change regularly, current ones are on the IRCC processing times page.

01
Consultation
We look at your status, relationship and history, and tell you which category and route fit. A consultation costs CAD 150.
02
Evidence and forms
We prepare the sponsorship and PR forms and organize the evidence. You both check and sign.
03
Submission
The partner submits both applications in the Permanent Residence Portal and pays the IRCC fees.
04
Biometrics and medical
IRCC sends instructions for fingerprints, photo and the medical exam. We explain what to do and when.
05
Decision
IRCC may ask for more documents or an interview. After approval, the partner confirms permanent residence and receives a PR card.

If you live in Quebec, there is one more step. After IRCC confirms the application, the sponsor signs an undertaking with the Government of Quebec.

Why spousal sponsorships get delayed or refused

Problems usually start with the relationship evidence or the sponsor's eligibility, so we check both before anything is filed.

Thin relationship evidence or stories that do not match
Sponsor was sponsored as a spouse less than 5 years ago
Sponsor receives social assistance for a reason other than disability
A family member was not declared in the application
Common-law couple with less than 12 months living together

Not ready to apply yet and just want your partner to visit? Start with a Canada visitor visa. Sponsoring parents or children instead - see family sponsorship.

Answers to frequently asked questions

How much does spousal sponsorship cost?
Our fee is CAD 2,000 per application. IRCC fees are CAD 1,260 for a spouse or partner, including the CAD 600 right of permanent residence fee, plus CAD 180 per dependent child and biometrics.
How long does spousal sponsorship take?
It depends on the route and IRCC workload. IRCC updates processing times regularly on its website, so we do not promise a fixed number of months.
Inland or outland - which is better?
Inland suits couples who already live together in Canada - the partner can apply for an open work permit while waiting. Outland works from anywhere and gives the sponsor a right to appeal a refusal. We choose based on where you live and your plans to travel.
Can my partner work while we wait?
With an inland application, yes - once IRCC confirms the PR application is complete, a partner who lives in Canada with the sponsor can apply for an open work permit.
Is there a minimum income to sponsor a spouse?
In most cases, no. Income matters only in rare cases, for example when a dependent child being sponsored has children of their own. Quebec has its own rules.
What counts as a common-law relationship?
At least 12 consecutive months living together in a conjugal relationship. Short trips apart are fine, but you need proof of a shared home, such as a lease, bills or the same address on documents.
I was sponsored by a spouse before. Can I sponsor now?
Not if you became a permanent resident through a spouse less than 5 years ago. You also cannot sponsor a new partner while you are still responsible for a previous one, which is 3 years after they became a permanent resident.
Can I sponsor my spouse if I live in the US?
A Canadian citizen can, if you show you will live in Canada once your spouse becomes a permanent resident. A permanent resident who lives outside Canada cannot sponsor.
Can we include our children?
Yes. Dependent children under 22 are added to the partner's application for CAD 180 each in IRCC fees. Every child must be declared, even one who is not moving to Canada.
