What humanitarian circumstances are considered “exceptional” and qualify for Permanent Residence?
There is no exact list or specific criteria for evaluation. In each case, they are assessed subjectively. Generally, the visa officer will pay attention to the following:
  • Reasons you cannot leave Canada;
  • Whether you have family, friends, or other connections in Canada;
  • What consequences would arise if you left Canada;
  • How your situation affects your children;
  • Whether you have health problems.
The main point is to prove that a refusal would seriously harm your safety, health, and life. For example, returning to your home country is impossible due to the risk of persecution, violence, etc. Or you have family circumstances preventing you from leaving relatives in Canada.
Can I apply on humanitarian grounds if I have already been rejected under another immigration program?
Yes. But keep in mind that you will have to justify the exceptional humanitarian circumstances.
What documents can confirm humanitarian circumstances?
It depends on the grounds you are providing in your application. These can include medical documents, court decisions, evidence of discrimination in your home country, and more. We will create a specific list tailored to your case.
What does “integration” into Canada mean?
It is important to show that you will not be a burden on the state, can support yourself, and ideally contribute to Canada. Proof of integration may include family ties, education, employment, volunteer work, participation in projects and organizations.
Can I work in Canada while my application is being processed?
Only if you have a work permit. Simply applying for PR on humanitarian grounds does not grant you this right.
Can I include multiple family members in my application?
Yes, you can include your spouse and children under 22 years of age who are also residing in Canada.
Do I need to attend an interview with the visa officer?
No, an interview is not required. However, it may be scheduled in exceptional cases to clarify details.
Is biometric data submission mandatory?
Yes. All applicants aged 14 to 79 are required to submit biometric data. You must submit biometric data even if you have already provided it for a visa.
Can I apply for PR on humanitarian grounds if I am in Ukraine?
No, the application can only be submitted if you are within Canadian territory.
How long does it take to process an application?
On average, your documents will be processed for about 20 months (48 months in Quebec), but the exact time may vary.
How does H&C differ from Refugees and Asylum (refugee program)?
H&C applies to people who do not meet the criteria of standard immigration programs but can prove that their deportation would lead to extreme hardship (e.g., danger to their life and their children’s lives). It is suitable for people already living in Canada.

Refugee – applies to people who face persecution in their home country due to race, religion, nationality, political views, or membership in a social group (e.g., LGBTQ+, activists, journalists) and need protection, even if they are not yet in Canada.
